Appeals Court Throws Out $368 Million Verdict Against Apple in VirnetX Lawsuit [iOS Blog]

Back in 2012, patent holding company VirnetX won a patent lawsuit against Apple over virtual private networking (VPN) connectivity related to Apple's FaceTime video calling feature. VirnetX was awarded $368.2 million after a jury trial.







The U.S. Court of Appeals for the Federal Circuit today threw out the decision, reports The Wall Street Journal , ruling that the verdict was influenced by the instructions given to the jury during the trial.

The U.S. Court of Appeals for the Federal Circuit, a specialized Washington-based court that handles patent appeals, ruled the verdict was "tainted" by erroneous jury instructions in the case. The court also held some trial testimony from a VirnetX expert should have been excluded from the case.

Despite siding with Apple and reversing some of $368 million verdict, the court did rule that Apple infringed on some of the claims in VirnetX's patents.



As a result of today's appeals court verdict, Apple and VirnetX will go back to trial court for further proceedings, further drawing out a lawsuit that first began in 2010.

Best Buy is currently offering a $50 discount Apple's Retina iPad mini as part of a Grad sale, dropping the price of the entry-level tablet to $349. Combined with a student deal that offers an additional $50 off, it's possible to get a Retina iPad mini for as little as $300.

NTT DOCOMO and Apple to Offer iPad in Japan Starting June 10

NTT DOCOMO and Apple have announced that iPad Air and iPad mini with Retina display will be available on the DOCOMO network beginning on Tuesday, June 10. “With the addition of iPad alongside iPhone, we now offer the complete lineup of Japan’s most popular mobile devices on the nation’s most reliable LTE network,” said Kaoru Kato, President and CEO of NTT DOCOMO, INC. Apple CEO Tim Cook added, “We are extremely happy for iPad to join iPhone on NTT DOCOMO’s network. A new alliance with Luxottica aims to inject some glamor into the eyeware line. iOS 7.1 includes a stern new warning

In addition to all the changes introduced with iOS 7.1, Apple has also added a new notification that warns users about how in-app purchases work by default, AppleInsider reports. The new warning message tells iOS users making in-app purchases for the first time that additional purchases are available in any app for a period of 15 minutes after the password has been entered. The warning message also offers a direct link to the Settings application, where the user can set the device to ask for the Apple ID password for each purchase, replacing the default 15-minute password-free purchase window.
